On September 5, 2007, the Centers for Medicare and
Medicaid Services published the "Phase III" final rule regarding
the physician self-referral prohibition, commonly known as the "Stark
Law." This third and final rule issued by CMS implementing the
Stark Law will become effective on December 4, 2007. This Final Rule
is in addition to the proposed fee schedule rule issued by CMS in July
2007, which contained several provisions related to the Stark Law. To
